Charges:
1 charge of fraudulent obtaining Loss of Earnings benefits pursuant to s116 of the Transport Accident Act 1986 and 1 charge of providing false or misleading information pursuant to s117 of The Transport Accident Act 1986.

Result:
The Magistrate sentenced the accused to a 12 month community Corrections Order with the accused to perform 120 hours of unpaid work, with conviction. The accused was also ordered to pay TAC $47,366 in restitution and costs of $2,249.
Remarks:
The accused applied for and received Loss of Earnings benefits. A proactive review of the accused’s claim discovered there were no corresponding medical claims in relation to the Certificates of Capacity that had been submitted to the TAC which disclosed that the Certificates had all been forged and were never actually issued by a medical practitioner. The subsequent investigation revealed the accused had also returned to work and further was also in receipt of Jobseeker payments all the while he was receiving Loss of Earnings benefits.
