Charges:

1 charge of fraudulent obtaining Loss of Earnings benefits pursuant to s116 of the Transport Accident Act 1986 and 1 charge of providing false or misleading information pursuant to s117 of The Transport Accident Act 1986.

Plea: Guilty

Result:

The Magistrate sentenced the accused to a 12 month community Corrections Order, with conviction, whereby the accused was also ordered to perform 100 hours of unpaid community work, undergo treatment programs for alcohol and drug addiction and undergo programs for mental health treatment.  The accused was also ordered to pay the TAC compensation in the amount of $36,212.62.

Remarks:

The accused was charged with fraudulently obtaining travel benefits and providing TAC with false or misleading information. The offending related to the accused providing TAC with numerous travel declarations claiming the accused had attended certain hydro therapy rehabilitation services in their private vehicle and was subsequently reimbursed. TAC’s investigation into the declarations revealed that numerous declarations were submitted and then resubmitted on multiple occasions.  It was also discovered that the accused had not attended the rehabilitation centres claimed to have been attended.  The accused also claimed to have travelled to a hospital 33 times in total but had only attended 6 times during the offending period.  In the plea in mitigation the accused identified a relapse into heavy drug use as the reason for offending and had several mental health issues as a result of her drug use.
