One charge of fraudulently obtaining a benefit contrary to s116 of The Transport Accident Act 1986 and 1 charge of providing false and misleading information contrary to s117 of The Transport Accident Act 1986.

Result:

The magistrate with a finding of guilt, ordered restitution of $7,327.32 inclusive of TAC’s costs in the sum of $945, the accused was fined $1,000. A stay to 19/06/2021 was also ordered to allow the accused to commence a repayment plan with the TAC.

Remarks:

The accused failed to advise the TAC of a return to employment whilst in receipt of TAC Loss of Earnings benefits. Certificates of Capacity were submitted stating the accused had nil capacity for employment and the accused on a number of occasions denied returning to work when questioned specifically via phone calls.
