MEDIA RELEASE: 12 April 2010

An Albion man yesterday pleaded guilty in the Sunshine Magistrate’s Court to defrauding the Transport Accident Commission (TAC) of over $12,000 from the end of September 2009 to April last year.

65-year-old Angelo Midiri contravened the Transport Accident Act 1986 by claiming loss of earnings benefits to which he was not entitled.  He returned to work whilst receiving these benefits from the TAC and did not inform the TAC that he had returned to work.

The court found Midiri guilty of fraudulently obtaining a benefit contrary to section 116 of Transport Accident Act 1986.

Midiri was sentenced without conviction and ordered to pay a fine of $1,000 and $500 for legal costs. There was no order for compensation as Midiri has repaid the fraud amount in full.

A TAC spokesperson said the organisation took fraud very seriously and where there was evidence of misconduct, the TAC would exercise its strong legislative powers to investigate and prosecute.
