Altona man convicted for defrauding TAC

An Altona man was last week sentenced in the Sunshine Magistrate's Court after being convicted for defrauding the Transport Accident Commission (TAC) of more than $40,000 over two years.

49-year-old Thy Duy Nguyen contravened the Transport Accident Act 1986 by claiming loss of earnings benefits to which he was not entitled. He returned to work post his transport accident from 1 October 2007 whilst receiving these benefits and did not inform the TAC of this development.

The court found Nguyen guilty of obtaining a financial advantage by deception contrary to section 116 of the Transport Accident Act.

Nguyen was convicted and sentenced to undertake a six month Community Based Order. He was also ordered to repay the TAC the full amount of $40,704.

A TAC spokesperson said the organisation took fraud very seriously and where there was evidence of misconduct, the TAC would exercise its strong legislative powers to investigate and prosecute.
