MEDIA RELEASE: 16 April 2010

A Rosebud West woman pleaded guilty this week in the Frankston Magistrate's Court to defrauding the Transport Accident Commission (TAC) of more than $6,000.

39-year-old Tania D'Alberto contravened the Transport Accident Act 1986 by claiming loss of earnings benefits to which she was not entitled.  She commenced a business whilst receiving these benefits and did not inform the TAC of this development. Ms D'Alberto also provided false information to the TAC indicating she had no capacity to work.

The court found D'Alberto guilty of obtaining a financial advantage by deception contrary to section 116 of the Transport Accident Act.

D'Alberto was fined $1,000 without conviction and was ordered to repay the full amount of $6,081.92 together with professional costs of $1,000.

A TAC spokesperson said the organisation took fraud very seriously and where there was evidence of misconduct, the TAC would exercise its strong legislative powers to investigate and prosecute.
