MEDIA RELEASE: 18 January 2011

A Botanic Ridge man today pleaded guilty in the Frankston Magistrate's Court to defrauding the Transport Accident Commission (TAC) of more than $4,000 over three months in 2010.

The 22-year old man contravened the Transport Accident Act 1986 by claiming medical benefits and support to which he was not entitled.

He provided false information in his claim form in relation to the accident circumstances and denied his claim for loss of earnings.

The court found the man guilty of obtaining a financial advantage by deception contrary to section 116 and 117 of the Transport Accident Act.

He was sentenced to undertake a twelve month Community Based Order and ordered to pay legal costs. There was no order for compensation because the Botanic Ridge man had already repaid the TAC the fraud amount in full.

A TAC spokesperson said the organisation took fraud very seriously and where there was evidence of misconduct, the TAC would exercise its strong legislative powers to investigate and prosecute.
