The TAC's role is to pay for treatment and benefits for people injured in transport accidents.
The Transport Accident Act 1986 guides the TAC in making decisions about the benefits that apply to claimants and any conditions that may apply.
Legislation states that claims can only be accepted by the TAC where the injury is directly caused by the driving of a motor vehicle.
The TAC endeavours to always consider claims with the utmost empathy and respect.
Following the Black Saturday Bushfires, the TAC funded the funerals of all 173 victims and has accepted the claims from bushfire survivors who suffered injuries as a direct result of them driving a motor vehicle at the time of the natural disaster.
The TAC's decision to deny the claims of Ray and Shaun Morgan is based on medical evidence provided to us which shows that their injuries were not suffered as a direct result of driving a motor vehicle.
As this case is now a matter for VCAT, there is nothing further the TAC can comment on.
